<p>Ken Salazar, Secretary of the Interior, is flying to Montana on Monday, April 2, to meet with Governor Schweitzer at the Bison Containment Facility on the Fort Peck Indian Reservation.  The publicity stunt by Secretary Salazar and Governor Schweitzer will be to sell the public on the grand scheme of introducing free roaming bison to Eastern Montana.<br />
It <strong>appears</strong>, out of the 68 bison shipped from Yellowstone National Park, that only approxamtly 54 remain as of last count. We urge our members to attend this event. The Containment Facility is located on Block 17, Township 3 North, Range 49 East.<br />
<strong>Directions to the event</strong>:</p>
<ul>
<li>Travel north out of Wolf Point on Hwy 13 to mile marker 23.</li>
<li>Turn right (east) onto County Road #172042 and travel 5.8 miles.</li>
<li>Turn right (south) onto a dirt road and continue half a mile to Containment Facility.</li>
</ul>
<p>CBU will continue to keep our members and supporters informed, as further information is obtained.  We appreciate your support of the folks in eastern Montana in their struggle to defend their private property against the re-introduction of free roaming bison.</td>

<p>Despite the injunction order signed this morning at 8:30AM, FWP loaded and shipped 4 additional bison to the Fort Peck Reservation today. The transport truck was stopped in route at some point but the shipment continued after reports were received that indicated one of the 4 bison was experiencing stress.</p>
<p>CBU filed the action below with the court to inform Judge McKeon of these recent turn of events and the violation of his order. Latest news reports the 4 bison have arrived in Fort Peck at this time.</p>
<p>Several questions need to be answered including why only 4 bison in this latest shipment. Were these 4 bison healthy enough to ship? What is the condition of all the bison at this time? Why did the shipment occur with a signed injunction in place? <br />
And how about &#8220;<strong>Who made the decision to ship these bison without public notice or informing the FWP Commission of the MOU or transport plan?&#8221;</strong></p>

<p>COMES NOW the Plaintiffs in the above-captioned case, by and through their under-signed Counsel, to provide notice to the Court of the following:</p>
<p>On March 22, 2012 at approximately 12:20-12:30 pm, Counsel for FWP informed Counsel for Plaintiffs that a shipment of four (4) bison from Corwin Springs quarantine area to the Ft. Peck bison holding facility was en route, despite this Court&#8217;s Temporary Restraining Order against such shipments.</p>
<p>            Both attorneys attempted to contact the Court on a conference phone in order to inform Judge McKeon of this event, but were unable to reach him.</p>
<p>            During two phone calls on the bison movement, Counsel Swanson asked Defense Counsel to contact the truck(s) hauling the bison and turn them around. Defense Counsel responded that FWP was unable to do that because the truck(s) were under the control of Ft. Peck Reservation personnel and/or federal employees of the Animal and Plant Health Inspection Service (APHIS), and that FWP did not have the authority or control to turn the truck around. Defense Counsel declined during the phone calls to ask the personnel hauling the bison to stop and turn around.</p>
<p>            The underlying facts and conversation is relayed in the attached Affidavit of Cory Swanson.</p>
<p>            Both attorneys committed to contacting the Court of this event.</p>

<li>Comes now Cory Swanson and declares under oath:</li>
<li>I was working in a conference room at a law firm in Helena, Montana with Co-Counsel Rachel Kinkie when I received a cell phone call from Defendant FWP Counsel Rebecca Jakes Dockter at approximately 12:20-12:30 pm on March 22, 2012. Ms. Dockter informed me that there was one or more trucks hauling four bison from the Corwin Springs quarantine facility to the Ft. Peck Reservation.</li>
<li>Ms. Dockter acknowledged she was aware of this Court&#8217;s TRO on March 22, 2012, but she informed me believed the shipment had departed from Corwin Springs before the FWP received notice of the TRO. It was FWP&#8217;s legal position that the shipment of March 22 was not a violation of the Court&#8217;s restraining order.</li>
<li>I placed the phone on speaker mode so Co-Counsel Kinkie could hear the conversation. I informed Ms. Dockter that the Plaintiffs&#8217; legal position was that the shipment did in fact violate the Court&#8217;s TRO, specifically paragraph 2, which I then read to her at that time or at a later point in the conversation. I asked Ms. Dockter to contact the truck(s) and tell them to turn around and return to Corwin Springs.</li>
<li>Ms. Dockter stated the trucks were no longer under FWP control because they were under Ft. Peck Tribal control, though she acknowledged the trucks were not at that time on the Ft. Peck Reservation.</li>
<li>Ms. Dockter and I tried to contact Judge McKeon by conference call at that time, but were unable to reach him. We agreed to talk again.</li>
<li>During a second phone call, Ms. Dockter stated she had intermittent phone contact with an employee of the Animal &amp; Plant Health Inspection Service who was in the truck. She believed they were somewhere near Terry, Montana. I informed Ms. Dockter that Terry was a long way from Ft. Peck, and they should turn around and return to Corwin Springs. Ms. Dockter stated she did not know if the APHIS personnel would agree to turn around because they were worried about the trauma a lengthy trip would have on one of the bison &#8211; a pregnant cow.</li>
<li>I asked Ms. Dockter if FWP had specifically asked the APHIS or other truck personnel to turn around and return to Corwin Springs. Ms. Dockter stated she had not so asked, and she would not commit to requesting that action.</li>
<li>After offering multiple alternatives to Ms. Dockter to stop the shipment, including the County Sheriff, the National Guard, and a phone call to Senator Baucus to contact the head of APHIS, I told her our position remained that the movement under way violated the Court&#8217;s order restraining such movements, and I would notify the Court.</li>
<li>During the phone call, I asked Ms. Dockter if she recalled that I had informed her on Tuesday, March 20th that I was filing a second Motion and Application for a TRO in the Court, and why she did not inform me at that time that there were four more bison to be shipped from Corwin Springs. Ms. Dockter stated she did recall my notifying her of the TRO Application, and that at the time of the call she was unaware that there were four additional bison to be shipped. She stated she was unaware of the shipment until after it had departed.</li>
</ol>

(see below) The judge has ordered FWP to restrained from transferring or transplanting Yellowstone Park bison from any existing holding facility. The judge has ordered all parties to appear in his <strong>Blaine County court in Chinook on April 11, 10AM</strong>, for oral augments on the case. <strong></p>

<p>The illegal relocation of bison from Corwin Springs to the Fort Peck Reservation is more than just a few bison being moved to the control of the tribes. This is the first step as stated by Secretary of Interior Ken Salazar to establish free roaming bison to the Eastern Montana landscape. To these people wanting to let diseased bison roam free, private property means absolutely nothing. Bison and wolves are the new found tools to force people off the land.</p>

<p>Numerous past occurrences of bison leaving the reservations in search of food during the winter have caused thousands of dollars of property damage. Bison on roadways endanger lives. The FWP under the direction of Governor Schweitzer have moved these bison in violation of state law and SB 212. Was the oath of office taken by our current governor just a matter of discretion as to what laws he follows?</p>
<p>Our Governor boasted to a trial attorney association meeting in Pennsylvania a few years back about how he manipulated and fixed the election for Senator Tester.</p>
<p>Our Governor told the Environmental Quality Council how he was going to take private property by eminent domain for expansion of the bison out of Yellowstone Park.</p>
<p>Our Governor is desperate for a legacy and come hell or high water he is bound and determined to establish free ranging bison in Montana. His actions of moving these bison without public notice and without a FWP Commission review of the MOU with the tribes is wrong. Please let your voice be heard on this important issue.</p>
<p>We need all the help we can get. The recent relocation of Yellowstone bison illegally by FWP &amp; Governor Brian Schweitzer to Fort Peck urgently needs your input on this situation. <p>Director Maurier and Governor Schweitzer have been successful in avoiding our injunction to stop the transport of bison to the Fort Peck Reservation. The agreement signed on Friday with the tribes (see below) was the first step in avoiding the injunction. The bison were loaded in trailers Monday morning with the final truck and trailer leaving the holding facility at noon.</p>
<p>This quick action by Maurier and the Governor was intended to avoid the injunction.</p>
<p>CBU filed action against Maurier, the FWP and Governor Schweitzer to stop this relocation attempt until compliance with SB212 was obtained and a state wide bison management plan was completed. FWP has refused to complete a state wide bison management plan but instead have decided they are above the law.</p>
<p>The bison now on the reservation makes our case more difficult as the reservation comes under federal jurisdiction. Our attorneys are reviewing the situation and we will provide further information soon on how CBU will proceed.</p>
<p>Here are a couple questions for our members and supporters to think about.</p>
<ul>
<li>Should this action by the Governor be considered a violation of his oath of office by violating state law and SB212?</li>
<li>Because of the Governor&#8217;s actions in violating state law, would a recall petition be appropriate or successful?</li>
</ul>

<p>MEMORANDUM OF UNDERSTANDING</p>
<p>BETWEEN</p>
<p>MONTANA FISH, WILDLIFE &amp; PARKS</p>
<p>AND</p>
<p>THE ASSINIBOINE &amp; SIOUX TRIBES OF THE FORT PECK RESERVATION</p>
<p>FOR</p>
<p>QUARANTINE FEASIBILITY STUDY BISON</p>
<p>&nbsp;</p>
<p>This Memorandum of Understanding (MOU) is entered into between Montana Fish, Wildlife &amp; Parks (MFWP) and the Assiniboine &amp; Sioux Tribes of the Fort Peck Reservation (FPT) on this 16th day of March, 2012.</p>
<p>&nbsp;</p>
<p>WHEREAS, bison is a keystone species that has important biological, cultural and recreational values, and has significant historical, socio-economic, cultural and religious value to the Assiniboine and Sioux Tribes and its members.</p>
<p>&nbsp;</p>
<p>WHEREAS, a Quarantine Feasibility Study (QFS) was developed by several cooperating agencies for the purpose of developing quarantine procedures, using the best available science and adaptive research strategies, to certify that individuals or groups of Yellowstone National Park (YNP) bison are free from brucellosis, including latent infections of brucellosis, and</p>
<p>&nbsp;</p>
<p>WHEREAS, MFWP desires to proceed to Phase IV of the QFS under the criteria and conditions developed in the 2005 QFS EA for continued monitoring within contained facilities with the desire that the QFS bison and/or their offspring could be available for conservation purposes at the completion of phase IV, and</p>
<p>&nbsp;</p>
<p>WHEREAS, QFS bison have been tested numerous times for brucellosis, and have repeatedly tested negative for brucellosis during Phase III of the QFS, and</p>
<p>&nbsp;</p>
<p>WHEREAS, 64 QFS bison have finished Phase III of the QFS and require a location where they and any offspring born over the 5 year monitoring period can continue to be tested for brucellosis, and</p>
<p>&nbsp;</p>
<p>WHEREAS, after a Montana Environmental Policy Act (MEPA) decision-making process, the MFWP Commission has approved the Assiniboine &amp; Sioux Tribe&#8217;s lands as an Interim Translocation Site for maintaining and managing up to 64 QFS bison pursuant to the protocol of the QFS with the longer-term objective of restoring and conserving the genetics of the Yellowstone Bison.</p>
<p>&nbsp;</p>
<p>THEREFORE LET IT BE RESOLVED, that MFWP and FPT enter into this Memorandum of Understanding to effect the transfer of up to 64 bison from the QFS facility to the Fort Peck Indian Reservation, for management of these bison and their progeny.  For the term of this MOU, MFWP and FPT agree that transferred bison will continue to be considered QFS bison.  Upon completion of the term of this MOU, MFWP and FPT agree that such bison will no longer be considered QFS bison, but will be under the sole jurisdiction of FPT.</p>
<p>&nbsp;</p>
<p>THEREFORE BE IT FURTHER RESOLVED, that for the purposes of future bison conservation on other tribal or public lands, up to twenty-five percent of the progeny of QFS bison will be made available to MFWP upon request.</p>
<p>A)    Term</p>
<p>The parties enter into this agreement for a term of up to five (5) years, commencing at the date of the final signature below and ending March 1, 2017. The parties reserve the right to negotiate past the termination date of this MOU for the continuance of any terms.</p>
<p>&nbsp;</p>
<p>B)    FPT Responsibilities</p>
<p>1)      The FPT will transport, or cause to be transferred, up to 64 QFS bison from the quarantine facilities near Gardiner, Montana directly to the Fort Peck Indian Reservation to be released within the boundaries of the Reservation. Any risk or loss with respect to transport of the bison from Gardiner to the Fort Peck Indian Reservation will remain with MFWP.</p>
<p>&nbsp;</p>
<p>2)      The FPT will release the QFS bison within the exterior boundaries of the FPT reservation into a pasture interior to those boundaries, designated as the surveillance pasture, which must be of adequate carrying capacity, and will consist of at least a seven foot, woven wire fence. FPT will be solely responsible for the care and management of QFS bison and any subsequent offspring. FPT will keep QFS bison within the surveillance pasture and separate from other FPT bison or livestock as required by the QFS Phase IV conditions. In order to prevent any potential disease transmission or genetic introgression, QFS bison must not commingle with other FPT bison or livestock at any time or under any circumstances, nor may QFS bison handling facilities be used for handling other non-QFS bison or livestock during the term of this MOU.</p>
<p>&nbsp;</p>
<p>3)      The FPT will coordinate with MFWP to design and implement an individual identification system for QFS bison prior to them being moved from the quarantine facility. FPT will keep records sufficient for MFWP to identify original QFS bison, their offspring, deaths and any future YNP/QFS additions. The FPT will make records available to MFWP within 10 business days upon request.</p>
<p>&nbsp;</p>
<p>4)      FPT will continue to disease test QFS bison and their offspring over the term of this MOU as per QFS protocol. MFWP will be allowed to observe all elements of testing upon request. The required testing will NOT occur during the calving season (April through June) of each year in order to avoid the potential for commingling of QFS bison with FPT bison or livestock.</p>
<p>&nbsp;</p>
<p>5)      FPT will allow for genetic testing of all QFS bison and progeny if such testing becomes necessary or desirable during the term of this MOU. Additionally, FPT will cooperate with MFWP, as is deemed necessary through the best available science, to regularly exchange like bison in order to maintain genetic diversity and prevent inbreeding of QFS bison.</p>
<p>&nbsp;</p>
<p>6)      If, for any reason, QFS bison escape from the surveillance pasture and/or the exterior Reservation boundaries, FPT has the sole responsibility to return escaped QFS bison to the surveillance pasture as early as practicable, but no more than within 72 hours of FPT&#8217;s knowledge of such escape. The intent is to address both the potential for disease transmission to QFS bison through commingling and the potential for damage caused by escaped QFS bison to persons or property outside the exterior reservation boundary.</p>
<p>&nbsp;</p>
<p>a)      Escape from Surveillance Pasture April through June but still within Reservation boundaries: If QFS bison escape during the April through June calving season and are not returned to the surveillance pasture within 72 hours and the QFS bison are found within Reservation boundaries, the FPT upon MFWP&#8217;s request will take lethal removal, quarantine, or testing actions as FPT and MFWP deem appropriate, for those QFS bison that have commingled or are suspected to have commingled with other bison or livestock on the Reservation.</p>
<p>b)      Escape from Exterior Reservation Boundary: If escaped QFS bison are not returned to the surveillance pasture within 72 hours, and they are found outside the exterior Reservation boundaries, MFWP reserves the right to lethally remove escaped QFS bison through any means necessary and allowed by law. QFS bison that move off the Reservation will be considered wildlife by MFWP, subject to applicable wildlife statutes and rules under Title 87 MCA. Tools for the removal of QFS bison off of the reservation include hazing or herding, trapping and transport, lethal removal by MFWP or FPT officials, and the issuance of kill permits to landowners affected by QFS bison that are off of the reservation. Trapping and transport is the preferred alternative.</p>
<p>c)      If, during the term of this MOU, QFS bison escape more than three times from the exterior Reservation boundaries due to the negligence of FPT, and such escapes result in substantial damage to persons or property and FPT fails to compensate for actual and reasonable damages within a reasonable time, FPT, upon MFWP request, will return original QFS bison and up to 25% of their progeny to MFWP.</p>
<p>&nbsp;</p>
<p>7)      FPT will be solely responsible for any damage to persons or property caused by the QFS bison should they escape. FPT will keep liability insurance to cover any claims during the 5 year monitoring period. FPT will disclose all claims to MFWP that have been filed on liability insurance. FPT will indemnify and hold MFWP harmless for any and all claims for damages to persons or property occurring during the term of this MOU and the placement of QFS bison on FPT lands caused by QFS bison escapes from the surveillance pasture.</p>
<p>&nbsp;</p>
<p>8)      FPT will ensure that adequate resources are available to maintain the surveillance pasture and care of QFS bison during the term of this MOU. To keep QFS bison from exceeding carrying capacity, either supplemental feeding or culling, or both, will be employed.</p>
<p>&nbsp;</p>
<p>9)      FPT will prepare status reports on all births, escapes, ingress, egress, deaths and other significant incidents related to QFS bison and provide such reports to MFWP on a quarterly basis.</p>
<p>&nbsp;</p>
<p>10)  Upon request, FPT will transfer to MFWP up to 25% of the progeny of QFS bison for the aforementioned conservation purposes.</p>
<p>&nbsp;</p>
<p>11)  FPT agrees that the Fort Peck Tribes/State of Montana Technical Committee is the appropriate committee to address any MOU issues.</p>
<p>&nbsp;</p>
<p>12)  FPT will provide reasonable access to MFWP for inspection of QFS bison or FPT facilities at any time and for any reason, given 24 hours&#8217; notice from MFWP.</p>
<p>&nbsp;</p>
<p>C)    MFWP Responsibilities</p>
<p>1)      MFWP will coordinate with the FPT to facilitate the transfer of up to 64 QFS bison from Gardiner, Montana to the Fort Peck Indian Reservation as provided above.</p>
<p>&nbsp;</p>
<p>2)      MFWP will coordinate with FPT to design and implement an individual identification system for QFS bison prior to them being moved from the quarantine facility.</p>
<p>&nbsp;</p>
<p>3)      MFWP reserves the right to remove QFS bison that are found outside the Reservation boundaries and are within the jurisdiction of the State of Montana as provided in Section B.6. above.</p>
<p>&nbsp;</p>
<p>4)      MFWP reserves the right to reasonably access and inspect QFS bison or FPT facilities at any time and for any reason, given 24 hours&#8217; notice from MFWP.</p>
<p>&nbsp;</p>
<p>5)      MFWP reserves the right to request and receive up to 25% of the progeny of QFS bison for the aforementioned conservation purposes. MFWP will notify the FPT of intent to recover such bison 180 days prior to any required transfer.</p>
<p>&nbsp;</p>
<p>6)      MFWP will cooperate with FPT, as is deemed necessary through the best available science, to regularly exchange like bison in order to maintain genetic diversity and prevent inbreeding of QFS bison.</p>
<p>&nbsp;</p>
<p>7)      MFWP will assist FPT in securing resources for feed. MFWP will work with federal and private partners to provide adequate funding for fencing of the surveillance pasture, handling facilities, and transportation to the Reservation described above.</p>
<p>&nbsp;</p>
<p>8)      Upon request, MFWP will, through the Montana Department of Livestock, provide portable bison handling and corral facilities for testing once per year.</p>
<p>&nbsp;</p>
<p>9)      MFWP agrees that the Fort Peck Tribes/State of Montana Technical Committee is the appropriate committee to address any MOU issues.</p>
<p>&nbsp;</p>
<p>D)    Assurance for Brucellosis Status</p>
<p>1)      Pursuant to QFS protocol, APHIS will be asked to assist FPT in their annual testing of the QFS bison and their offspring to ensure that the bison continue to be brucellosis-free during the term of this MOU.</p>
<p>&nbsp;</p>
<p>2)      Pursuant to QFS protocol, APHIS will be asked to assist FPT with removal of any afterbirth from bison that abort during pregnancy, to determine the status of brucellosis antibodies.</p>
<p>&nbsp;</p>
<p>3)      In the event a QFS bison tests sero-positive for brucellosis, and so long as the FPT has complied with the terms of this MOU, the FPT will be responsible for addressing any outbreak in accordance with the Tribes Foreign Animal Disease Emergency Preparedness and Response Plan. In the event a QFS bison tests sero-positive for brucellosis due to commingling because of a material violation of a term of this MOU, MFWP reserves the right to address the outbreak in accordance with APHIS and Montana Department of Livestock authorities, which may include lethal removal of all QFS bison. MFWP will make best efforts, to the extent allowed by law, to contain any such response solely to QFS bison and their offspring, and not to other FPT bison or livestock.</p>
<p>&nbsp;</p>
<p>E)     Indemnification</p>
</div>
<p> FPT agrees to protect, defend, and save MFWP and its elected and appointed officials, agents, and employees, harmless from and against all claims, demands, causes of action of any kind or character, including the cost of defense thereof, against MFWP and their elected and appointed officials, agents, and employees on account of bodily or personal injuries, death, or damage to property arising out of the negligent acts or omissions of FPT.</p>
<p>&nbsp;</p>
<p>MFWP agrees to protect, defend, and save FPT and its elected and appointed officials, agents, and employees, harmless from and against all claims, demands, causes of action of any kind or character, including the cost of defense thereof, against FPT and its elected and appointed officials, agents, and employees on account of bodily or personal injuries, death, or damage to property arising out of the negligent acts or omissions of MFWP</p>
<p>&nbsp;</p>
<p>F)     Liaison and Service of Notices</p>
<p>Unless otherwise designated by the FPT Chairman and the Director of MFWP, the liaisons for day-to-day implementation of this MOU shall be the FPT Fish and Wildlife Director and the MFWP Region 6 Bureau Chief. All written notices, reports and other information required to be exchanged between the parties must be directed to these persons, with copies to the FPT Chairman and the Director of MFWP.</p>

<p>Montana Fish, Wildlife &amp; Parks (MFWP) and the Assiniboine &amp; Sioux Tribes of the Fort Peck Reservation (FPT), as parties of the aforementioned MOU, recognize and agree that of the 64 QFS bison being transferred to FPT, half of the animals, or up to 32 bison, are to be further transferred to the Gros Ventre &amp; Assiniboine Tribes of the Fort Belknap Reservation (FBT).</p>
<p>This transfer will take place as soon as is practical, following MFWP&#8217;s indication that adequate facilities are in place on the Fort Belknap Reservation to receive QFS bison.</p>
<p>MFWP will assist FPT in securing resources for feeding FBT-bound bison during this interim period.</p>
<p>&nbsp;</p>
<p>FPT will provide care for FBT-bound bison according to the terms of the aforementioned MOU, and will assist MFWP in selecting for transfer half of the animals, or up to 32 bison, that are balanced for age and gender between the two groups.</p>

<p>CITIZENS FOR BALANCED USE FILES BISON LITIGATION</p>
<p>Citizens for Balanced Use joins with United Property Owners of Montana and six other plaintiffs in filing litigation against Montana Fish Wildlife &amp; Parks to stop relocation of state managed bison. The case was submitted to the Montana Seventeenth Judicial District Court in Blaine County.</p>
<p>GALLATIN GATEWAY, Mont.— Citizens for Balanced Use (CBU) joined in filing a lawsuit demanding that FWP Director Joseph Maurier, Montana Fish, Wildlife &amp; Parks (FWP) and the Montana Fish, Wildlife &amp; Parks Commission be held accountable for violating state law in enacting a bison translocation plan without a state-wide management plan or impact analysis. Montana state law requires that the FWP and Commission &#8220;develop and adopt a management plan before any wild buffalo or bison under the department’s jurisdiction may be released or transplanted onto private or public land in Montana&#8221; (MCA 87-1-216(5).</p>
<p>Balanced Use cites damages to private property caused by the mismanagement of bison located on neighboring lands.</p>
<p>&#8220;The current fences on the Reservation are not holding the bison,&#8221; said Dustin Hofeldt, a plaintiff and landowner neighboring the Ft. Belknap Reservation. &#8220;I have nearly $20,000 in damages because of wandering bison. I haven’t been compensated for these damages to my property. The state needs to follow the laws set to protect landowners and our agriculture producers, not crowd more buffalo onto the range, making the problem worse.&#8221;</p>
<p>The suit contests the FWP’s violation of Sen. Rick Ripley’s (also a plaintiff) recently passed Senate Bill 212, which requires a management plan be developed before transporting bison. The FWP Director has received a recommendation to post-pone the transportation plan from the Montana Legislative Environmental Quality Council, but the department ignored this recommendation.</p>
<p>&#8220;The disregard for property rights and the rule of law by the Fish, Wildlife &amp; Parks is alarming and must be brought to the attention of Montanans,&#8221; said Kerry White, Executive Board of Balanced Use. &#8220;I proudly stand with the members of CBU and fellow plaintiffs in this plea to protect both public and private land.&#8221;</p>
<p>The suit also notes the state’s failure to follow the Montana Environmental Policy Act by not fully examining the impact on neighboring landowners and past discrepancies with the current Tribal bison containment and compensation system.</p>
<p>Citizens for Balanced Use joins with State Sen. Rick Ripley, Dustin and Vicki Hofeldt, Fmr. State Sen. Ken Hansen, The United Property Owners of Montana and Missouri River Stewards in filing this suit.</p>

			<content:encoded><![CDATA[<p></p><h3>Gallatin National Forest 9<sup>th</sup> Circuit Appeal Decision,</h3>
<p> </p>
<p>The 9<sup>th</sup> Circuit of Appeals issued their opinion on December 1, 2011 in regards to our appeal of Judge Molloy’s ruling on the Gallatin National Forest Travel Plan. Prior to this December 1<sup>st</sup>  ruling  the 9<sup>th</sup> Circuit requested all parties to meet and attempt to mediate the issue. The 9<sup>th</sup> Circuit provided a professional mediator though the court and CBU, through our attorney, participated in the mediation meetings.</p>
<p> CBU is committed to keeping those uses that were in place and allowed in 1977 to remain. We believe this issue will be settled at some point in time but nothing was accomplished during the mediation meetings and all parties decided to let the court make their decision.</p>
<p>The 9<sup>th</sup> Circuit was then charged with making a decision which was rendered on December 1, 2011. Judge Fisher wrote in his opinion that the Forest Service failed to address 1502.22 (b)(2) of the Administrative Procedures Act and NEPA. 1502.22 (b)(2) directs the Agency “ to provide a statement of relevance of the incomplete or unavailable information to evaluating reasonably foreseeable significant adverse effects on the human environment”. The Forest Service claimed in the Travel Plan DEIS and FEIS that no historic use data was available and therefore did not need to be considered. The court disagreed.</p>
<p>CBU provided the Forest Service with a substantial amount of historic use data during the comment period of the DEIS but this information was ignored. When the Forest Service was questioned by CBU as to why our information on historic use was not considered or used, their response was that “they did not know what to do with it”. Clearly our historic information was important to our continued use of the WSA but under Forest Supervisor Becki Heath, and her closure agenda team at that time, they were not interested in historic use of the WSA. Their decision to ignore our historic use documentation was a mistake and the courts have centered on this issue in their rulings.</p>
<p>The decision by Judge Molloy in the original case provided direction to the Forest Service to close additional areas to motorized and mechanized use to protect the “Wilderness Character”. The 9<sup>th</sup> Circuit disagreed with Judge Molloy and his reasoning by writing the following opinion.</p>
<p>“<em>We do not necessarily agree with the district court, for example, that the only way (the service’s) decision can survive the arbitrary and capricious standard of review is to substantially reduce the overall area for vehicle use or to reduce overall motorized and mechanized vehicle access. Although the Service might reasonably compensate for an increase in the volume of motorized use by reducing the overall area of impact, we do not assume that this is the only proper response to the increased volume of use when relevant data are scarce. We do assume there may be other reasonable management responses to the problem the Service faces.”</em></p>
<p><em> </em></p>
<p>This statement in the court’s opinion supports our additional litigation which is continuing in Judge Hayden’s court. We challenged the additional closure of the WSA through the Interim Order issued for the last three years by GNF Supervisor Mary Erickson. Her Interim Order closed additional area in the WSA to winter motorized use. During the mediation talks CBU requested a stay in our action on the Winter Interim Closure case in front of Judge Haddon until such time as the mediation was either successful or a failure.  When the mediation talks broke down CBU asked Judge Haddon to again consider our case.</p>
<p>We expect a ruling on our Interim Closure case from Judge Hayden in the near future. As for where we go next on the 9<sup>th</sup> Circuit ruling, it looks like the Forest Service will need to start the Travel Planning process all over again. We should again have the opportunity to comment on the Forest Service’s new proposal and submit additional historic use data in this area prior to 1977. We ask everyone to dig through your old photos and talk to folks that used this area. Gather signed affidavits and statements of use of the HPBH WSA prior to 1977 and provide this information to CBU. We have historic use information which we will again submit to the Forest Service but any additional information we can provide will help in our fight.</p>
<p>CBU will continue our efforts in preserving historic use of the HPBH WSA and on a different front we are also working with Representative Rehberg and his cosponsoring of HR 1581, the Wilderness and Roadless Area Release Act introduced by Representative McCarthy from California. If this bill were to pass it would release the HPBH back to multiple uses. This is something that should have been done years ago and our members and supporters can help us by contacting Representative Rehberg to express your support for HR 1581.</p>
